Terms of Service

These terms govern your use of the Apex Drafting Services website and any drafting, CADD, or design engagement with Apex Drafting LLC. Please read them before requesting a quote or engaging our services.

1. Acceptance of These Terms

By accessing this website or engaging Apex Drafting Services (referred to in these terms as "Apex," "we," "us," or "our") for drafting, CADD, or design work, you ("client," "you") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use this website or engage our services. We may update these terms from time to time, and the version posted at the time of your engagement governs that engagement.

2. Services We Provide

Apex Drafting Services provides residential architectural drafting and CADD services, delivered 100% remotely to clients nationwide. Our services include:

3. Use of This Website

This website is provided for the purpose of informing you about our services and allowing you to request a quote or contact our team. You agree to use this website only for lawful purposes and not to:

4. Quotes and Engagements

Before any work begins, Apex will work with you to define a project scope covering the type of drawings needed, the property or project details, and any specific requirements you have. A quote is issued based on that scope. Work does not begin until the scope is agreed and the engagement is confirmed.

If project requirements change materially after work has started, such as changes to square footage, structural layout, or the number of design iterations requested, this may require a revised scope and an updated quote. We will always communicate this with you before performing out-of-scope work.

Quotes are based on the information provided by the client at the time of the request. If site conditions, jurisdictional requirements, or project details differ materially from what was described, the scope and quote may be adjusted accordingly.

5. Payment Terms

A deposit is typically required before work begins on a project, with the remaining balance due upon delivery of final drawings. The specific deposit amount, payment schedule, and accepted payment methods are confirmed at the time of quote and included in your project agreement.

Final files, including permit-ready sets, are released once payment in full has been received, unless alternate arrangements have been agreed to in writing. Delayed payment may result in a delay of project delivery or a pause in active work.

Any project cancelled after work has begun may be subject to charges for work already completed, calculated based on the stage of the project at the time of cancellation. This will be addressed in your project agreement.

6. Revisions

Each engagement includes a set number of revision rounds, confirmed at the time of quote based on the scope and complexity of the project. Revisions within that scope are provided as part of the agreed price. Requests that go beyond the included revisions, or that introduce changes outside the original scope, may be treated as additional work and quoted separately before we proceed.

We ask that revision feedback be consolidated and submitted together where possible, so changes can be applied efficiently and your project stays on track.

7. Licensing and Use of Delivered Drawings

Custom Plans

Drawings produced under a custom design engagement are typically licensed for use on the specific project and site for which they were created. This generally means the plans are intended for a single build at the address or parcel specified in your project agreement, not for resale, reproduction, or use on other properties or by other parties, unless you have agreed to a different license with us in writing.

Stock Plans

Plans purchased from our stock house plan catalog carry different, more limited usage terms than custom work. Stock plan licenses typically govern how many times a plan may be built, whether modifications are permitted, and whether the plan may be shared or resold. The specific license terms for any stock plan are presented and confirmed at the time of purchase.

General

In all cases, the exact scope of your license, including any restrictions on copying, modifying, reselling, or reusing the drawings, is confirmed in writing at the time of purchase or engagement. Apex retains ownership of its underlying design work product except as expressly licensed to the client. If you have questions about what your license permits, ask us before proceeding with a build or a resale of any kind.

8. Permitting and Engineering Disclaimer

Apex Drafting Services provides drafting and design services. Our drawings are not a substitute for required local permitting review, and submission of our drawings to a permitting authority does not guarantee approval. Local jurisdictions vary in their codes, review processes, and requirements, and it is the client's responsibility to submit drawings through the appropriate local permitting process and to address any jurisdiction-specific requests or corrections that arise during that review.

Where a local jurisdiction requires a structural engineering stamp, that stamp is obtained separately through a licensed engineer. Apex does not provide structural engineering services or engineering stamps as part of our drafting and design work. Clients are responsible for engaging a licensed engineer where required and for coordinating any engineering input needed to satisfy local code or permitting requirements.

9. Limitation of Liability

We take care to produce accurate, well-prepared drawings based on the information and requirements provided to us. That said, to the fullest extent permitted by law, Apex Drafting LLC's total liability arising out of or related to any engagement, whether based in contract, warranty, tort, or any other legal theory, is limited to the amount paid by the client for the specific project giving rise to the claim.

Apex is not liable for indirect, incidental, consequential, or special damages, including but not limited to construction delays, cost overruns, permitting denials, or losses arising from third-party contractor, engineer, or builder errors, even if we have been advised of the possibility of such damages. This limitation does not apply where prohibited by law.

Nothing in these terms is intended to limit liability for gross negligence or willful misconduct where such limitation is not permitted under applicable law.

10. Client Responsibilities

To keep your project on schedule and accurate, you agree to provide complete and accurate information about your property, project goals, and any known site conditions or constraints, respond to requests for feedback or approvals in a reasonably timely manner, and independently verify that final drawings meet your expectations and local requirements before submitting them for permitting or construction.

11. Termination

Either party may end an active engagement by written notice if the other party materially fails to meet its obligations under the project agreement, subject to the payment terms described above for work already completed. Sections of these terms that by their nature should survive termination, including licensing, liability, and payment obligations for completed work, will continue to apply.

12. Governing Law

These terms are governed by the laws of the State of Arizona, without regard to conflict of law principles, unless otherwise required by the law of the jurisdiction where a specific project is located.

13. Changes to These Terms

We may revise these Terms of Service from time to time to reflect changes in our services or for legal or operational reasons. The updated version will be posted on this page with a new "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
